They say there are many steps between a notice of violation and a fine. Also that large fines should only be for egregious violators.

That is the biggest GDPR problem. you can make legislation, if you do not have staff to maintain it (whatever they don't have in the member states), it makes 0.0 sense.

Apart from the content, the GDPR is a failure.
The regulations should already be available in 2016 to make an easy transition possible for May 2018. However, they have adjusted various matters in the meantime.

California Governor Jerry Brown Thursday signed off on one of the strictest privacy laws in the U.S. in what could be a sign of legislative things to come in a post-European Union General Data Protection Regulationsworld.

The California Consumer Privacy Act of 2018, which goes into effect from 2020, mirrors many of the provisions of GDPR in that it puts strict regulations in place as to how online companies deal with customer data.

At its crux, the legislation gives California residents the right to know what data a company has collected on them as well as the ability to control what a company does with that data. Upon request, companies operating within the state must now disclose what information it collects, why it collects the data and to whom it sells the data. Consumers will have the legal right to compel companies to delete any data a business has gathered about them or opt out of their data being shared or sold.

The law further prevents companies from retaliating against customers who chose to opt out of their data being shared but does allow companies to offer financial incentives to customers in return for the right to collect data and share it.

In the event that a company fails to comply with the law, the state can impose a fine and consumers can sue a company for a breach of the law up to $750 for noncompliance or a data breach.

Xenforo has an update for getting closer to that but I haven't done the update yet - need to find a good chunk of spare time to investigate

hehe.. Google and Facebook is going to be impacted by this one Google weeps as its home state of California passes its own GDPR fines are $7,500 violation per user !

Any company that holds data on more than 50,000 people is subject to the law, and each violation carries a hefty $7,500 fine. Needless to say, the corporations that make a big chunk of their profits from selling their users' information are not overly excited about the new law.

"We think there's a set of ramifications that's really difficult to understand," said a Google spokesperson, adding: "User privacy needs to be thoughtfully balanced against legitimate business needs."

and Facebook did all that hard working moving users out of EU early too !

So far no word from Facebook, which put 1.5 billion users on a boat to California back in April in order to avoid Europe's similar data privacy regulations.

Privacy And Well-Being – Q2 saw the debut of Europe’s GDPR that forced Facebook to change its privacy policies and get users to agree to how it collects data about them. Wehner blamed GDPR for Facebook loss of users in Europe. That law and Facebook’s Cambridge Analytica scandal led the company to have to improve its privacy controls. These could make it tougher for Facebook to target people with ads or show their content to more people.

Tried the GDPR data export from Spotify. By default, you get like 6 JSON files with almost nothing. After many emails and complaining and a month of waiting, I got a 250MB archive with basically EVERY INTERACTION I ever did with any Spotify client, all my searches. Everything.

Any interaction I ever did, including window sizes, connection timeouts, what song I stopped when. Nothing particular interesting, just every-freaking-thing.

The General Data Protection Regulation, which came into force on Towel Day, applies to any processing carried out by firms operating in the EU, and those offering goods or services to people in the EU.

That meant the law had major implications for the technical design of large numbers of websites, along with how organisations retained and protected personal data and informed users about that collection and use – at least in theory.

Interesting to revisit GDPR seems Google wins in court that GDPR's 'right to be forgetten' only applies for EU only visitors Google wins case as court rules “right to be forgotten” is EU-only !

The Court of Justice of the European Union, the EU's highest court, issued a ruling today finding that there is no obligation under EU law for a search service to carry out a valid European de-listing request globally.

"EU law requires a search engine operator to carry out such a de-referencing on the versions of its search engine corresponding to all the Member States," the Court wrote in a statement (PDF), "and to take sufficiently effective measures to ensure the effective protection of the data subject's fundamental rights."
